Terms of Service

By using any services Envescent, LLC provides, you agree to all of the following terms and conditions:

All traffic is subject to monitoring. We will monitor where traffic is coming from or going to, at what rate and what services are being used. We will not monitor the contents of the traffic (such as sensitive or private information) unless we see malicious activity, such as hacking, denial of service, spam, phishing or other conduct we deem to be inappropriate or illegal. Suspicious traffic or activity will be logged and reported.

Acceptable Use Policy:
  • Although Envescent, LLC will endeavour to provide as reliable a service as possible, we shall not be held liable for any loss or damages caused by the unavailability of our (or any affiliated, managed, or hosted) servers.

  • The customer is bound by the law of Arlington, Virginia, agreeing and understanding these terms of service willingfully and without reserve by using Envescent.

  • The customer shall not use any domain hosted by Envescent, LLC to `spam' or provide any tools designed to aid spammers (such as bulk mailers).

  • The customer shall never perform acts causing denial of service, elevating their user privelages without proper authorization from Envescent, LLC (either in contract or written and delivered by a trusted carrier), use the services provided to harass, abuse, compromise, or cause any damages to other individuals, organizations, businesses, militaries, educational institutions, governments, or other establishments.

  • The customer is responsible for the contents of the web pages they host with Envescent, LLC. It is their responsibility to ensure that they do not violate US law and that copyrighted material is used with the permission of the copyright holder. It is also their duty to ensure that no adult material or offensive content is hosted on their site at any time or the site may be suspended indefinitely without a refund.

  • Data stored on our servers is not guaranteed to be backed up (unless otherwise specified). It is the customers responsiblity to ensure that they have backups of important data.

  • No refunds will be issued for any reason on any account. If the customer still has an outstanding amount due to Envescent then we reserve the right to retain control of the domain and any subsequent content being hosted or stored by Envescent, LLC until this amount is paid.

  • Envescent reserves the right to cancel customer accounts on the basis of abuse, failure to pay on time, any wrongdoing against Envescent customers, employees, extraneous entities and/or actions deemed unacceptable by the executive staff.

  • The customer must represent him or herself accurately and must be of 18 years of age or older (if not in US than of adult age in their home country) to be legally bound to this agreement. Otherwise we will not do business with the customer.

  • If a site is generating traffic that is detrimental to access to other sites hosted by us we reserve the right to throttle, limit, or disable access to that site. Note that this is only for traffic exceeding the agreed bandwidth for the customers site.

  • Envescent reserves the right to change these terms of service.

  • The consumer assumes responsibility for legal fees pending any proceedings, litigation, arbitration, or related legal services.

  • By using Envescent products and services the customer acknowledges and is bound to these terms willingfully and without reserve as applicable.

Warning:

Unauthorized access to this computer system
(or any other computer system on this network) is prohibited
by title 18 USC 1030 (a). Violators are subject to criminal and
civil penalties under title 18 USC 1030 (b). Pursuant to title 18
USC section 2511 (2)(a)(i), any and all monitoring of user
activity may take place on this system (or any other systems
on this network) by the management.
